Kimmel Carter Associate Appears on Local Talk Show to Discuss Workers' Compensation and the Lati

On February 18, Kimmel Carter associate Brian S. Legum appeared on La Conexión, a talk show on WITN22 Wilmington, to address the rights that those in the Latino community have within the Delaware workers’ compensation system, as well as some of the legal concerns Latino immigrants may have.

In his conversation with host Yesenia Taveras, Legum, who works primarily with Spanish-speaking clients at Kimmel Carter, described his passion for helping the Latino community, especially Latino workers, to navigate the legal process. Latinos have a strong pride and a great work ethic, Legum said, but unfortunately many in the community do not understand the rights that they have, especially related to workers’ compensation.

“The rights that someone is entitled to under workers’ compensation, if they’re injured in the course and scope of employment, are quite numerous,” Legum said. “[The rights of injured workers may include] medical expenses related to their injuries, the payment of wages if they are unable to work due to their injuries and compensation for any permanent impairment.”

Since there are not many Spanish-speaking lawyers in the area, Legum felt that he had an important opportunity to educate the community about their legal rights.

“The majority of my practice within the firm is working with Hispanic individuals who have gotten injured on the job, and educating them on their rights, and making sure that they get the compensation they deserve,” Legum said.

Many Latino immigrants, he said, fear the possibility of speaking to an attorney or seeking compensation as injured workers if they do not have the proper immigration documents, but Legum explained that workers’ compensation rights “are completely separate and distinct” from a worker’s immigration status. During the interview, he urged anyone who is injured in a work accident to set up a consultation with an attorney.

“It’s important when I meet with my clients that I explain to them that everything we talk about is confidential, but if they do happen to have an immigration issue I make sure that we communicate with an immigration lawyer,” Legum said.

“The community should know that they can come and speak to an attorney and learn about what their rights are – and not be worried that initiating that conversation is going to have any effect on their status as a documented or undocumented person.”
