Brian Legum Speaks at Social Media and the Law Seminar

Kimmel Carter associate Brian Legum and Young Conaway associate Molly DiBianca addressed a group of Delaware lawyers and other professionals in a Bifferato Trial Seminar on Social Media and the Law on Friday, February 20.

The seminar was part of the Bifferato Trial Practice Forum, a speaker series held in the New Castle County Courthouse that is designed to provide free continuing legal education (CLE) credits to new lawyers and to offer young attorneys an opportunity to network with both each other and more experienced attorneys.

Legum and DiBianca focused their presentation on the use of social media as means of evidence discovery, discussing the rising popularity of sites like Facebook and Twitter and the procedure and ethical guidelines lawyers should follow when collecting evidence from an individual’s social media accounts.

Social media can be particularly relevant to workers’ compensation and personal injury cases, as insurance companies can make discovery requests of clients’ online posts that are relevant to the accident, such as photos and comments about one’s injuries.

“Clients need to be wary of what they post on social media, because once it’s put out there, it’s for everybody to see,” Legum said. “Any statement that you make online could come back to harm your case, so you should check with your attorney before you state anything about an accident.”
